Home owners’ association is simply an organization created to manage the development of homes. The developer is relieved of legal and financial responsibilities and the ownership is transferred to the homeowners from the association only of selling a certain number of lots which is predetermined. These home owner associations are incorporated together and are subject to the terms and or conditions which are used to govern nonprofit organizations. One can be well aware of the laws of the home owner associations but these laws change from one state to another and in fact some states do not have home owner association laws at all. Statistics show that Home owners association governs about 23 million homes in the United States of America.

Home owners association exercises a number of powers like a municipal government. These associations maintain and regulate the activities and the main difference between a home owner association and the municipal government is that home owners association is not subjected to any constitutional constraints. If not for these home owners association, the tasks and duties performed by it would fall on the local government which would be an additional burden. The other discretionary powers of a home owners association is that it can form committees and appoint officers to these committees.

Home owners association provides a number of benefits not only for the local government but also to the people in that area. These associations maintain harmony and enforce regulations. The cost incurred by these associations in any public cause activity such as insuring structures or landscaping areas shared by all is levied as assessments from members. Though many people feel that preferring home owners association can be misleading, yet advocates personally suggest people to go for home owners association. The biggest advantage which municipalities enjoy from home owners associations is that property taxes can be charged any amenities in the state which may not be the case if these were owned by the municipalities.  Also the municipalities are exempted from the responsibility of maintaining these amenities.

In spite of so many advantages with home owners associations, members in these associations are subjected to financial risk as well. In a few states in America, these associations can go on to deprive the homes of members in order to collect assessments. This leaves the people at risk though this is not the same in all the states. In the other states judicial procedures are maintained by home owners association.
