Eviction, is a very legal procedure a property-owner can use to get rid of a renter from a house, apartment, or room. This procedure is also popularly known as summary process. Eviction is also known in many other names like unlawful detainer, forcible detainer and repossession. Other terms exist but these are the most popularly used terms.  To be simple and straight, eviction is way of communication between a person owning a land and tenant or a renter.

Basing on the law in the jurisdiction, for a landlord to get rid of a tenant and win a law suite, the process or procedure to be followed depends. So, laws in different states are different with respect to eviction. Though procedures are different most of the part is common. A Notice of quit should be sent by the landlord to the tenant first. This copy is attached to Form A which has the signatures of landlord and his attorney. This should be delivered by a state Marshal. This notice simply states that the tenant should leave the place or land by a date specified and a reason why he/ she should leave.

As soon as the notice is received the tenant should contact of a lawyer and take his assistance. If this notice is not a court order , the tenant need to not leave the apartment by the specified date. If the landlord is not satisfied , he would start the court action by submitting against you a Complaint. A copy of this is affixed to Form B. The complaint forms are typically two or three pages of sheets, completely attested by the landlord’s legal representative. The foremost sheet, the order, is an authorized court form. This explains the deed in opposition to you and what should be done to defend your rights. In the upper right hand corner of the his sheet, is a box noticeable stating the date of return. You will not need to have to go to court of law on that date, but you or your legal representative should file a paper called an APPEARANCE from within  the court in only two days after the return date. One copy of this appearance form  is to be  attached to  Form C. You should get the appearance form stated above from the clerk’s office and ask the clerk for clear directions on how to fill it the form.
